The following outlines the terms of service for using this website. This is a legally enforceable contract that affects your legal rights, including with respect to how claims and disputes are resolved.
Most of you probably won’t read this entire policy page, but it is here for your protection. It can pretty much be summed up by this brief statement: 

We are not, nor plan on, being in the business of selling anyone’s data; any data collected is used internally to gain perspective on user interactions with our website, to ultimately create a pleasurable and safe user experience for all.

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from justinwjohn.com (the “Site”).


1. PERSONAL INFORMATION WE COLLECT

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

When you visit the Site, we automatically collect the information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device.

When you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, PayPal accounts, etc.), email address, and phone number. We refer to this information as “Order Information”.

Personal data is not just created by your interactions on this site but is also generated from technical processes such as contact forms, comments, cookies, analytics, and third-party embeds.

By default, WordPress does not collect any personal data about visitors, and only collects the data shown on the User Profile screen from registered users. However, some of the plugins this site uses may collect personal data and will be outlined here.

Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”.

We collect Device Information using the following technologies:

2. COOKIES

If you leave a comment on our site you may opt-in to save your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year.If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

3. HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to (1) Communicate with you; (2) Screen our orders for potential risk or fraud; and when in line with the preferences you have shared with us, (3) provide you with information or advertising relating to our products or services.

4. SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to help us use your Personal Information, as described above. For example, we use Google Analytics to help us understand how our customers use the Site.

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

7. YOUR RIGHTS

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

If you are a European resident, you have the right to access your personal information we hold about you and to ask that your personal information is corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

8. DATA RETENTION

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

We may keep contact form entries for six months, analytics records for five years, and customer purchase records for ten years.

9. CHANGES

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

3. ACCURACY, COMPLETENESS + TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. Certain products or services may be available exclusively online through the Site. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot 100% guarantee that your computer monitor’s display of any color will be accurate to our products.

We reserve the right but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates so that we can complete your transactions and contact you as needed.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. 12. MAILCHIMP FOR WOOCOMMERCE

When shopping, we keep a record of your email and the cart contents for up to 30 days on our server. This record is kept to repopulate the contents of your cart if you switch devices or needed to come back another day. 13. AKISMET

We collect information about visitors who comment on Sites that use our Akismet anti-spam service. The information we collect depends on how the User sets up Akismet for the Site, but typically includes the commenter’s IP address, user agent, referrer, and Site URL (along with other information directly provided by the commenter such as their name, username, email address, and the comment itself).

14. PATREON FEATURES ON WORDPRESS

In order to enable you to use this website with Patreon services, we save certain functionally important Patreon information about you on this website if you log in with Patreon.

These include your Patreon user id, Patreon username, your first, last names, and your vanity name. Additionally, the id of your campaign at Patreon and your campaign’s Patreon URL are also saved.

If you request that your data be deleted from this website, this data will also be deleted and Patreon functionality will not work. You would need to register on this website and log in to this website with Patreon again in order to re-populate this data and have Patreon functionality working again.

15. USER CONTENT + COMMENTS

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.

We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

16. PERSONAL INFORMATION, MEDIA + CONTACT FORMS

Your submission of personal information through the Site and Shop is governed by our Privacy Policy as stated above.

If you upload media files, let it be known that all uploaded files are usually publicly accessible. If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

The contact form plugin used on this site is for the purpose of the nature in which the user begins the communication. If you use it to sign up for marketing purposes such as my newsletter, etc. then expect your infomation to be kept in our database for that purpose. If you use the contact for inquiry about any order information, it will be kept in our customer database pertaining to any order information. You have access to that information by going to the main page of this site and clicking the ‘log in’ link.

17. litespeed-cache

This site utilizes caching in order to facilitate a faster response time and better user experience. Caching potentially stores a duplicate copy of every web page that is on display on this site. All cache files are temporary and are never accessed by any third party, except as necessary to obtain technical support from the cache plugin vendor. Cache files expire on a schedule set by the site administrator, but may easily be purged by the admin before their natural expiration, if necessary.

18. ERRORS, INACCURACIES + OMISSIONS

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. 22. SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

24. ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

What are cookies in computers?

Also known as browser cookies or tracking cookies, cookies are small, often encrypted text files, located in browser directories. They are used by web developers to help users navigate their websites efficiently and perform certain functions. Due to their core role of enhancing/ enabling usability or site processes, disabling cookies may prevent users from using certain websites. Cookies are created when a user’s browser loads a particular website. The website sends information to the browser which then creates a text file. Every time the user goes back to the same website, the browser retrieves and sends this file to the website’s server. Computer Cookies are created not just by the website the user is browsing but also by other websites that run ads, widgets, or other elements on the page being loaded. These cookies regulate how the ads appear or how the widgets and other elements function on the page.

Standard uses for browser cookies

Website servers set cookies to help authenticate the user if the user logs in to a secure area of the website. Login information is stored in a cookie so the user can enter and leave the website without having to re-enter the same authentication information over and over.  Session Cookies are also used by the server to store information about user page activities so users can easily pick up where they left off on the server’s pages. By default, web pages really don’t have any ‘memory’. Cookies tell the server what pages to show the user so the user doesn’t have to remember or start navigating the site all over again. Cookies act as a sort of “bookmark” within the site. Similarly, cookies can store ordering information needed to make shopping carts work instead of forcing the user to remember all the items the user put in the shopping cart. Persistent or tracking Cookies are also employed to store user preferences. Many websites allow the user to customize how information is presented through site layouts or themes. These changes make the site easier to navigate and/or lets user leave a part of the user’s “personality” at the site.

Cookie security and privacy issues

Cookies are NOT viruses. Cookies use a plain text format. They are not compiled pieces of code so they cannot be executed nor are they self-executing. Accordingly, they cannot make copies of themselves and spread to other networks to execute and replicate again. Since they cannot perform these functions, they fall outside the standard virus definition. Cookies CAN be used for malicious purposes though. Since they store information about a user’s browsing preferences and history, both on a specific site and browsing among several sites, cookies can be used to act as a form of spyware. Many anti-spyware products are well aware of this problem and routinely flag cookies as candidates for deletion after standard virus and/or spyware scans. The way responsible and ethical web developers deal with privacy issues caused by cookie tracking is by including clear descriptions of how cookies are deployed on their site. These privacy policies should explain what kind of information is collected and how the information is used. Other cookie-based threats

Since identity protection is highly valued and is every internet users right, it pays to be aware of what threat cookies can pose. As cookies are transmitted back and forth between a browser and website, if an attacker or unauthorized person gets in between the data transmission, the sensitive cookie information can be intercepted.  Although relatively rare, this can happen if the browser is connecting to the server using an unencrypted network like an non-secured WiFi channel. Internet security is only attainable if you regualrly use a anti-virus protection program.  Other cookie-based attacks involve exploiting faulty cookie-setting systems on servers. If a website doesn’t require browsers to use encrypted channels only, attackers can use this vulnerability to trick browsers into sending sensitive information over insecure channels. The attackers then siphon off the sensitive data for unauthorized access purposes. New Laws for the use of cookies and other technologies that store online user information. On May 26th 2011, new rules governing the use of cookies by websites comes into force in Europe. Rather than the “Opt out” option for website visitors, websites will need to specifically gain the consent of their visitor and they must “Opt In” to be able to store cookies on their computer or other devices.This is expected to be difficult to manage and enforcement will more than likely be done subtlely and with encouragement rather than with the threat of fines and penalties.

What does the new law say?

The new requirement is essentially that cookies can only be placed on machines where the user or subscriber has given their consent.  6 (1) Subject to paragraph (4), a person shall not store or gain access to information stored, in the terminal equipment of a subscriber or user unless the requirements of paragraph (2) are met.
(2) The requirements are that the subscriber or user of that terminal equipment — (a) is provided with clear and comprehensive information about the purposes of the storage of, or access to, that information; and (b) has given his or her consent. (3) Where an electronic communications network is used by the same person to store or access information in the terminal equipment of a subscriber or user on more than one occasion, it is sufficient for the purposes of this regulation that the requirements of paragraph (2) are met in respect of the initial use.

“(3A) For the purposes of paragraph (2), consent may be signified by a subscriber who amends or sets controls on the internet browser which the subscriber uses or by using another application or program to signify consent.
(4) Paragraph (1) shall not apply to the technical storage of, or access to, information — (a) for the sole purpose of carrying out the transmission of a communication over an electronic communications network; or (b) where such storage or access is strictly necessary for the provision of an information society service requested by the subscriber or user.

Key tips for safe and responsible cookie-based Web browsing

Due to their flexibility and the fact that many of the largest and most-visited websites use cookies by default, cookies are almost unavoidable. Disabling cookies will lock a user out of many of the most widely-used sites on the Internet like Youtube, Gmail, Yahoo mail, and others. Even search settings require cookies for language settings. Here are some tips you can use to ensure worry-free cookie-based browsing:

  • If you haven’t already, set your browser to update automatically. This eliminates security vulnerabilities caused by outdated browsers. Many cookie-based exploits are based on exploiting older browsers’ security shortcomings.
